Matt West Media: Terms of Service
By booking a service with Matt West Media, you agree to the following terms. Please read them carefully, as they form the agreement between you (the Client) and Matt West Media (the Service Provider).
1. Booking & Scheduling
Service Availability: All bookings are subject to availability. Appointments are finalized only upon confirmation by the Service Provider.
Property Readiness: The property must be "shoot-ready" upon arrival. We do not provide cleaning or decluttering services. If the property is not ready, we will shoot the property in its current state or, at our discretion, reschedule (subject to a $75 rescheduling fee).
Client Presence: It is highly recommended, though not required, that the listing agent or a responsible representative be present to approve the shot list. If the agent or responsible representative is absent, Matt West Media will use professional judgment to capture the property’s best features.
2. Payment & Invoicing
Payment Terms: Invoices are generated and managed through the Service Provider's online portal. Payment must be processed via the integrated payment gateway before the final delivery of media assets.
Late Fees: Currently, there is no fee for late payments. Given that media will not be released until paid for, payments should be made in a professionally reasonable timeframe (preferably within 24 hours after delivery is made). Repeated delays in payments may result in the requirement of prepayment for future bookings for that specific client.
3. Cancellation & Rescheduling
Notice Period: Cancellations or requests to reschedule must be made at least 24 hours prior to the scheduled shoot time.
Fees:
• Cancellations made within 24 hours of the shoot are subject to a $75 cancellation fee.
• "No-shows" (where the photographer arrives at the property but cannot gain access) are subject to a $75 no-show fee.Inclement Weather: We reserve the right to reschedule outdoor/aerial shoots due to adverse weather conditions (rain, high winds, or low cloud cover) at no additional charge to, or discount from, the booked package. We will make every effort to return to the property and finish the shoot as soon as possible; even same-day, if feasible.
4. Aerial & Drone Operations
FAA Compliance: Certified by the FAA for Part 107 operations, all drone shoots are conducted in strict accordance with applicable regulations.
Airspace Restrictions: We are legally prohibited from flying in certain national security airspaces, and legally restricted to certain lower altitudes in others (near airports, government facilities, etc.). If a property is in a restricted zone, we may be unable to perform aerial services at higher altitudes which can significantly constrain the spatial perspective of the Client's property listing, depending on the height of nearby trees and buildings. Airspace feasibility for media production will be determined prior to arrival, and we will communicate any expected impacts to the order the Client placed so that adjustments can be made, if necessary. We will always obtain clearance from controlling authorities (air traffic control, government facility director, etc) prior to aerial operations.
Safety: The pilot-in-command has the final authority to cancel or limit aerial photography/videography based on safety concerns or wind conditions.
5. Intellectual Property & Usage Rights
Ownership: Matt West Media retains full copyright of all images, videos, and media assets captured, edited, and delivered. These rights will last in perpetuity.
Licensing: Upon full payment, the Client is granted a non-transferable, non-exclusive license to use the media for the marketing of the specific property listed.
Third-Party Use: This license does not extend to third parties (e.g., stagers, contractors, interior designers). Third parties must purchase separate licensing if they wish to use the media for their own portfolios or marketing.
Archiving: We reserve the right to archive media for our own portfolio and marketing purposes.
6. Deliverables & Specifications
Photo Counts: Deliverables adhere strictly to the photo counts specified in your selected Suite. Requests for additional angles or shots beyond the package scope will be treated as an "Additional Photo Pack" add-on.
Floor Plans (CubiCasa): Floor plans are provided for marketing purposes only. They are not certified surveys or blueprints. Square footage, room dimensions, and furniture layouts are approximations. Official square footage for legal disclosures must be verified by a licensed appraiser.
Editing: Media is delivered with our signature color-grading and professional edits. Requests for extensive manual retouching (e.g., sky replacement, object removal beyond standard editing) may incur additional fees.
7. Limitation of Liability
Damage/Loss: Matt West Media is not responsible for any damage to the property, loss of personal items, or issues arising from the condition of the home during the shoot.
Technical Failure: While we employ redundant data backup systems, Matt West Media is not liable for data loss due to equipment failure or unforeseen technical issues. In such rare events, our liability is limited to a full refund of the shoot fee.
Property Accuracy: The Client is responsible for the accuracy of all property details (listing address, square footage, features) represented in the marketing media.
8. Acceptance of Terms
By placing an order via our website and booking portal, you acknowledge that you have read, understood, and agreed to these Terms of Service.
